By registering as a member of KARV or otherwise participating in any services offered by Karv Global Ltd (collectively referred to herein as “KARV”), I acknowledge and agree to the following:
1. Participation in Activities
1.1 I understand that I will be participating in fitness classes, personal coaching, wellness programs, workshops, and other exercise activities, including but not limited to the use of KARV’s gym facility, equipment, and sauna (collectively, the “Activities”).
1.2 I acknowledge that these Activities are offered by KARV, its owners, instructors, coaches, employees, contractors, and other service providers.
2. Assumption of Risk
2.1 I understand that participation in the Activities involves inherent risks, including but not limited to:
- Physical exertion, which may result in injury, abnormal blood pressure, heartbeat disorders, heart attacks, muscle, back, or bone injuries, and in rare cases, death.
- The sudden malfunctioning of equipment.
- The provision of instruction, training, supervision, dietary recommendations, or other guidance from KARV staff.
2.2 I acknowledge that I am in good physical and mental health and able to participate in the Activities. I understand that it is my responsibility to consult a physician or medical professional before engaging in any physical activity.
2.3 I accept full responsibility for my participation in the Activities and agree to stop any activity if I feel unwell, unsafe, or uncomfortable.
3. Waiver & Release of Claims
3.1 In consideration of being permitted to participate in the Activities, I knowingly, voluntarily, and expressly waive, release, and forever discharge any claims (“Claims”) I may have against KARV, its owners, members, instructors, coaches, employees, contractors, service providers (whether employed or voluntary), and landlord (each a “Released Party”) for any injury, damage, or loss sustained as a result of participating in any Activity.
3.2 I agree to indemnify and hold harmless each Released Party from any loss or liability incurred in defending any Claim made by me or anyone on my behalf, even if the Claim is alleged to result from the negligence of any Released Party.
3.3 For the purpose of this waiver, “Claim” includes, but is not limited to, liabilities, demands, expenses, legal actions, and rights of action for damages, personal injury, mental distress, or death.
4. Acknowledgment of Safety Responsibilities
4.1 I agree that when participating in any Activity without direct supervision from KARV instructors, coaches, or fitness professionals, I will:
- Be mindful of my surroundings and other gym patrons.
- Avoid performing any exercise, motion, or Activity that I do not feel safe or comfortable doing without direct support.
- Seek feedback and guidance from KARV staff regarding the correct use of equipment or techniques.
- Request modifications if needed.
5. Media Release
5.1 I grant KARV and its representatives permission to use photographs and videos of me taken during my participation in the Activities for promotional, advertising, or social media purposes.
5.2 If I choose not to allow the use of such media, I must notify KARV in writing.
6. Intellectual Property Rights
6.1 I acknowledge that the KARV name, logo, and other intellectual property are the sole property of KARV. I agree not to use, replicate, or publish any KARV branding, materials, or proprietary information without prior written consent.
7. Compliance with Facility Rules & Policies
7.1 I understand and agree to comply with all facility rules, etiquette policies, and any other terms set by KARV.
7.2 I acknowledge that KARV reserves the right to deny or terminate my participation in any Activity at its sole discretion, including but not limited to medical or fitness-related concerns.
8. Governing Law
8.1 This Waiver & Release of Liability shall be governed by and construed in accordance with the laws of the Cayman Islands.
9. Understanding & Agreement
9.1 I acknowledge that I have read, understood, and voluntarily agree to be bound by the terms of this Waiver & Release of Liability.
9.2 I understand that by signing this waiver, I am giving up substantial rights, including my right to sue, and that this agreement is binding upon my heirs, next of kin, executors, administrators, and assigns (“Successors”).
9.3 I acknowledge that failure to accept the terms and conditions of this waiver may result in the immediate termination of my membership with KARV, without a refund of any amounts paid.
